To maximize the benefits of mediation, turnaround professionals should understand the mediator's approach, preparation, and method for conducting the mediation process. This program brings together three experienced, well-known mediators, to discuss their views of how a mediator prepares for and conducts mediation and the tools they use to bring the parties together. Panelists will discuss:
- Scheduling mediation to optimize the likelihood of success.
- How the mediator will prepare for the mediation session, and how you can expect the mediator to use his or her analysis of the facts and law in his discussions with the parties.
- The critical importance of the party’s mediation statements and how they differ from briefs submitted to courts in litigation.
Join us to answer the questions: Should the parties expect the mediator to provide an assessment of the merits of the case? Should a mediator adopt an evaluative or facilitative approach? How might the mediator respond to an apparent impasse? What value could mediation provide for the parties and their professionals, even if the mediation does not produce an immediate agreement on all issues?
