Higher education institutions facing financial pressure operate in a uniquely complex environment, where regulatory constraints, governance dynamics, industry culture and market conditions can limit traditional restructuring options. With bankruptcy and receivership options often unavailable, schools are frequently forced to pursue alternative restructuring options while managing enrollment sensitivity and reputational concerns. At the same time, decision-making can be complicated by board dynamics and the long lead times required for changes to take effect. This panel will provide a high-level overview of the key challenges shaping distress in the sector and discuss practical considerations and potential paths forward.
