Turnaround Square: WARN Act Update

Zoom Meeting   Visit Website
Wednesday, August 23, 2023 12:00 PM - 1:00 PM   iCalendar Central Standard Time

Please join turnaround advisors from the legal and interim-management communities to discuss how large corporations are approaching mass layoffs in today’s environment. The 60-minute conversation will focus on the Federal WARN Act (Worker Adjustment and Retraining Notification Act) requirements and employment law (min-WARN Act) provisions. You can expect the expert panel will provide a general overview of employers’ obligations and in-depth look at employees’ rights, including claims related to termination. In addition, the group will explore the intersection of bankruptcy law and employment law – examining the implications of mass layoffs and how that may differ from state to state.

Continuing Education Credits:

  • 1.2 CPE credits in Business Law
  • 1.2 CEU credits
  • 1.0 CLE credits (approved in DE and PA with accepted reciprocity in AZ, CA, CT, FL, NJ, and NY; pending approval in IL and TX)

Intended Audience:
All turnaround, restructuring, and related industry professionals are welcome. Specifically, though, this session may appeal to turnaround consultants and advisors, labor and employment lawyers, bankruptcy lawyers, and any restructuring professionals seeking to better understand the intersection of bankruptcy and labor law.

Expected Prior Knowledge:
The intended audience is not expected to have any prior knowledge of the topic.

Objectives:
Following the session, attendees will be able to...

  • describe the WARN Act in overview  in order to outline employers’ obligations and employees’ rights.

  • analyze the implications of mass layoffs in the context of the WARN Act in order to inform their actions in turnaround and termination decisions.

  • differentiate the varying implications and impacts of WARN by state in order to apply best practices to their own work with varying clients.
