Our mock trial team is back for Part Two –
Join the Minnesota Chapter of the Turnaround Management Association to witness the team tackle the issues involved in a motion to appoint a receiver, and when the borrower objects to the motion. In addition to whatever outlandish ad libs our presenters come up with, this presentation we will address topics including:
- The bank’s legal and factual basis for appointment;
- Whether defaults have actually occurred;
- Whether a receivership is actually necessary;
- Whether there are less imposing means for the parties to achieve their goals.
The trial team will be finalized soon. We will hear from the lender, the borrower, and the proposed receiver on all of these issues and more.
